Spam policy
We are not in the business of SPAMing mobile consumers. We recognize and support UK regulations in this respect and will limit our application and service to businesses who follow similar principles.
Maximms campaigns should always be targeted towards identified customers or subscribers who have opted into receiving communications from given or known organizations. In all outgoing communications from our mobile marketing applications we will recommend that companies and agencies include within their message an opt-out or unsubscribe option so the recipient may elect termination of future messages if desired. All messages created and campaigned directly by Maximms as a service will include this by default.
Our terms and conditions of use identify anti-spam rules. Your understanding and acceptance of our anti-mobile spam policy is important to us as part of our contract. We ask professionally that you pay attention to this important area of contract obligation as the strictest measures may cause immediate termination of contract.
Maximms has links into professional organizations who provide legitimate sources of opt-in subscribers for given demographics e.g. specific age group. If this service is important to your campaign please contact us directly to discuss.
Content
Maximms reserves the right to suspend or terminate the service if we find mobile campaigns are professionally misleading or contain illegal or overly offensive content potentially unacceptable to a recipient. We offer advice on content acceptability if needed. Please contact us prior to your campaign delivery if you are uncertain of the nature or viability of the content you wish to send.
All legal responsibility for content and any intellectual property or copyright material including content included in any message campaigned via the Maximms application remains solely and entirely with the originating client.
If you think you've been sent an offensive or misleading MMS Marketing Message via the Maximms application, please address this issue with the sender prior to contacting Maximms. If the complaint isn't resolved to your satisfaction, please send full details to enquires@maximms.com . We will not adjudicate on individual disputes but we will monitor complaints in light of whether the sender should be allowed to continue their association with Maximms.
If we receive direct complaints in relation to offensive or misleading content sent via Maximms we will pass these onto the originator of the campaign for response and action. Ongoing complaints or lack of response to similar or existing results may result in a suspension of the service for the user in extreme cases.
